论城市规划和管理中的规制和利导原则及其应用

On the regulations and guides and their application in Chinese urban
planning and management

【摘要l论文认为由于城市中存在大量
的负经济外部性，应建立与市场有机
结合的一套规则或制度引导城市健康
地成长和发展。像市场规制在其他领
域一样，城市管理和规划中的市场规
制原则为:使私人成本等于社会成本，
私人收益等于社会收益。在社会主义
市场经济条件下，城市规划者可以通
过对自己掌控的、影响城市发展和空
间配置的要素的规划来引导城市达到
其合理结构。因势利导的原则除了系
统性外，还有近远期相结合的原则。
论文对规制和利导原则在交通结构和
交通定价、土地合理定价与土地利用、
城市空间战略、土地利用和交通系统、
城市发展与土地供给等方面的应用进
行了论述。

[Abstract]In this paper, the author
proposes that some regulations should be
instituted to internalize the negative
externalities to improve cities' development
and growth in Chinese urban management
and planning. The rule of market regulation
is that private cost equals social cost, or
private revenue equals social revenue as it
is in other fields. Meanwhile, urban
planner can lead cities to achieve its
reasonable scale and spatial structure by
planning some urban controllable factors in

1引论
    城市规划和管理是建设和谐
的城市，促进城市健康成长和发
展的两个紧密联系的重要方面。
    按照约翰·M·利维的说法，
之所以需要城市规划是因为城市
中存在大量的相互关联性
( interconnectedness)和复杂性
(complexity)。但用规划的办法
来处理这两个重要的现象，在世
界上存在多样性，即使在发达的
欧美，欧洲大陆与英美就存在着
明显的差异。我国的城市规划有
着悠久的历史，但近现代的城市

规划受西方和前苏联的影响大。
改革开放以来我国城市规划界的
思想非常活跃，在规划理论、方法
和实践诸方面取得了大量非常有
价值的成果。然而，我国的改革
开放在逐步深人，为了适应新形
势，探索适合中国国情的城市规
划理论和方法仍旧是中国城市规
划界的一项重要的历史任务。
    城市管理，即运用法律、行
政、经济等手段或措施以保证城
市各项活动能够顺利进行。城市
管理中的一种称作控管
(governance )，比如用地规模控
制，土地用途管制等，它们往往是
强制性的，在城市管理中十分重
要，是依据城市规划或城市建设
与管理的需要而设立的，被广泛
地应用。
    本文中所谓的规制
(regulation)不同于控管，意指利
用建立的一套规则或制度引导城
市健康成长和发展。中所谓的利
导，是指通过对影响城市发展和
空间配置的要素的规划来引导城
市达到其合理结构的办法，而这
些要素又在城市规划者的掌控之
中。本文希望对这两个方面的探
讨能对我国的城市规划和管理研
究添砖加瓦。
